Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and LuxeSurgeons, Inc. ("Company," "we," "us," or "our") regarding your use of the LuxeSurgeons platform, website, and services (collectively, the "Services").

By creating an account, browsing our website, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

To use our Services, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Not be barred from using the Services under applicable law
• Provide accurate and complete information
• Not have been previously banned from our Services

LuxeSurgeons provides:

• Surgeon search and comparison tools
• Booking and scheduling services
• Patient reviews and ratings
• Concierge and travel coordination
• Payment processing for consultations and deposits
• Educational content and resources

We act solely as an intermediary between patients and medical providers. The actual medical services are provided by independent, third-party surgeons and facilities.

We make reasonable efforts to verify surgeon credentials, including:

• Board certification status
• Active medical licenses
• Hospital privileges
• Professional background

However, we cannot guarantee the accuracy of all information. You are responsible for conducting your own due diligence before selecting a surgeon.

• 14+ days before consultation: Full refund minus $50 processing fee
• 7-14 days before: 50% refund
• Less than 7 days: No refund
• Surgeon cancellation: Full refund

Surgery deposit refunds are subject to individual surgeon policies. Contact the surgeon directly for their specific refund policy.

You agree NOT to:

• Provide false or misleading information
• Impersonate others or create fake accounts
• Post defamatory, harassing, or inappropriate content
• Violate any laws or regulations
• Attempt to hack, disrupt, or reverse engineer our platform
• Use automated tools to scrape our data
• Interfere with others' use of the Services

All content on LuxeSurgeons, including text, graphics, logos, images, software, and design, is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works without our express written permission.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any medical outcomes, complications, or injuries
• We are not liable for surgeon negligence or malpractice
• We are not liable for travel issues, delays, or cancellations
• Our total liability is limited to the amount you paid us
• We are not liable for indirect, incidental, or consequential damages

You agree to indemnify and hold harmless LuxeSurgeons, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Medical procedures you undergo

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any disputes shall be resolved through binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association. You waive your right to a jury trial.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of our Services after changes constitutes acceptance of the modified Terms.
