By accessing or using LuxeSurgeons ("Platform," "Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

LuxeSurgeons is a medical tourism platform that connects patients with board-certified surgeons worldwide. We provide:

• Surgeon search and matching services
• Booking and consultation coordination
• Travel and accommodation assistance
• Financing options through third-party partners
• Concierge and support services

Important: LuxeSurgeons is a platform connecting patients with surgeons. We do not provide medical services directly, practice medicine, or guarantee outcomes.

3. Medical Disclaimer

All medical decisions are between you and your chosen surgeon. Always consult with qualified medical professionals before making healthcare decisions.

4. User Accounts

4.1 Account Creation

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Notify us immediately of unauthorized access
• Be at least 18 years of age

4.2 Account Responsibilities

You are responsible for all activities under your account. We are not liable for any loss or damage from your failure to maintain account security.

5. Surgeon Verification

We conduct verification of surgeon credentials including:

• Board certification verification
• Medical license validation
• Malpractice history review
• Professional references

However: Verification does not constitute an endorsement, recommendation, or guarantee. You should conduct your own research before choosing a surgeon.

6. Bookings and Payments

6.1 Booking Process

When you book through our platform:

• You enter into a direct agreement with the surgeon/clinic
• LuxeSurgeons facilitates the booking but is not a party to the agreement
• Payment terms are set by the surgeon/clinic
• We may charge a platform fee or receive a commission

6.2 Platform Fees

Our fees and payment structure will be clearly disclosed before booking. Fees are non-refundable unless otherwise stated.

6.3 Payment Processing

Payments are processed securely through Stripe. We do not store your credit card information. See our Privacy Policy for details.

7. Cancellations and Refunds

7.1 Cancellation Policy

Cancellation policies vary by surgeon and procedure. You must review the specific cancellation policy before booking. Generally:

• 60+ days before: Full refund minus platform fee
• 30-60 days before: 50% refund
• Less than 30 days: No refund

7.2 Refund Process

Refunds are processed within 10-14 business days to the original payment method. Refund eligibility is determined by the surgeon's policy.

8. User Conduct

You agree NOT to:

• Provide false or misleading medical information
• Impersonate any person or entity
• Use the Service for any illegal purpose
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access
• Reverse engineer or copy any part of the platform
• Use automated systems to access the Service without permission
• Harass, abuse, or harm other users or surgeons

9. Intellectual Property

The Service and its original content, features, and functionality are owned by LuxeSurgeons and are protected by international copyright, trademark, and other intellectual property laws.

You may not use our trademarks, logos, or branding without prior written consent.

10. Limitation of Liability

• LuxeSurgeons is not liable for any medical complications, injuries, or adverse outcomes
• We are not responsible for surgeon negligence or malpractice
• We are not liable for travel delays, cancellations, or issues
• Our total liability is limited to the fees you paid to us
• We are not liable for indirect, incidental, or consequential damages

11. Indemnification

You agree to indemnify and hold harmless LuxeSurgeons, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your medical treatment or procedures

12. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of information
• Uninterrupted or error-free service

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes shall be resolved through:

1. Good faith negotiation between parties
2. Binding arbitration in Miami, Florida
3. Small claims court (for claims under $10,000)

13.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Email to your registered address
• Prominent notice on the platform
• In-app notification

Continued use after changes constitutes acceptance of the new Terms.

15. Termination

We may terminate or suspend your account immediately, without prior notice, for:

Upon termination, your right to use the Service will immediately cease.
